Terms of Service

These Terms of Service govern your access to and use of fitgtx.shop, including purchases made through our online store.

By using our website or placing an order, you agree to these Terms to the extent permitted by applicable law.

Mandatory consumer rights under German or European Union law remain unaffected.

1. Online Store

fitgtx.shop provides an online storefront through which customers may browse and purchase products offered for sale.

We may modify our product range, website content, pricing, availability, and features from time to time, subject to existing contractual obligations and applicable law.

2. Customer Eligibility

By placing an order, you confirm that you have the legal capacity required to enter into the relevant transaction or that you have valid authorisation from a parent, guardian, or other authorised person where required by law.

You must provide accurate information during checkout.

3. Product Information

We make reasonable efforts to present product descriptions, photographs, specifications, dimensions, colours, and other information accurately.

Actual colours may vary depending on display settings, lighting, manufacturing differences, or other technical factors.

Where a material product characteristic differs from the description supplied at the time of purchase, statutory consumer remedies may apply.

4. Prices

Prices applicable to a purchase are those displayed through the store and checkout at the time the order is submitted, subject to correction of obvious errors where legally permitted.

Applicable taxes and mandatory charges will be handled according to applicable law.

Standard shipping is free for all orders.

5. Orders

Submitting an order constitutes an offer to purchase the products included in the order.

We may decline or cancel an order where legally permitted, including where:

• A product is unavailable;
• Payment cannot be authorised;
• Order information is materially incorrect;
• Fraud or unauthorised payment is reasonably suspected;
• A clear pricing or technical error has occurred;
• Fulfilment would violate applicable law.

If payment has already been collected for an order that we validly cancel, the appropriate amount will be refunded.

Customers agree to provide valid and authorised payment information.

Payment processing may be carried out through Shopify or third-party payment service providers.

7. Shipping

fitgtx.shop offers free standard shipping on all orders.

The estimated delivery timeframe is 15–20 days, unless another delivery estimate is clearly communicated for a particular order.

Shopify recommends displaying delivery estimates and shipping information for customers shopping in Germany.

Delivery estimates are not intended to eliminate statutory rights where delivery is legally delayed.

8. Delivery Information

Customers are responsible for providing complete and accurate shipping information.

If an incorrect address is supplied, contact info@fitgtx.shop promptly.

We cannot guarantee that shipping information can be amended after fulfilment begins.

9. Risk and Ownership

Risk in goods passes according to applicable consumer law.

Nothing in these Terms is intended to transfer shipping risk to a consumer where applicable law requires the trader to bear that risk.

10. Right of Withdrawal

Eligible consumers purchasing through distance contracts generally have a statutory right to withdraw within 14 days, subject to legal exceptions.

German law recognises the right of withdrawal for qualifying distance contracts, with a general 14-day period.

11. Returns and Refunds

Returns and refunds are handled according to our Return and Refund Policy and mandatory applicable consumer protection legislation.

Nothing in these Terms limits statutory remedies relating to defective or non-conforming goods.

12. Availability

Products may become unavailable without notice.

Placing a product in a shopping cart does not guarantee availability until the order has been accepted and processed.

Where we cannot fulfil an order, we will take reasonable steps to notify the customer and refund applicable amounts.

13. Intellectual Property

Unless otherwise stated, content displayed through fitgtx.shop, including website design, text, graphics, layouts, and other materials, is protected by applicable intellectual property law or used with permission.

You may use the website for personal, lawful shopping purposes.

We are not responsible for failure or delay caused by circumstances outside our reasonable control to the extent permitted by law.

Such circumstances may include severe weather, natural disasters, transportation disruption, labour disruption, government action, customs delays, internet outages, major infrastructure failures, or other exceptional circumstances.

Mandatory consumer rights remain unaffected.

19. Changes to These Terms

We may update these Terms for future use of the website.

Changes will not retroactively remove contractual or statutory rights relating to orders already concluded unless legally permitted.

The current version will be published on fitgtx.shop.

20. Governing Law

These Terms are governed by applicable law, including mandatory consumer protection rules that apply to customers purchasing from Germany.

Where a consumer has mandatory rights under the law of their country of habitual residence, nothing in these Terms is intended to deprive the consumer of those protections.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
